TERMS OF SERVICE
This Terms of Service (these "Terms" “TOS”) creates a binding agreement between you ("you," “your”) and SwiftXR Technology Inc. ("SwiftXR," “Company”, “we,” “us” or “our”). These Terms govern your use of SwiftXR’s platform and website https://home.swiftxr.io/ and any subdomains (the “Site”) and the products and services, content, features, functionality and information available on the Site and/or any mobile application (an “Application”) we may offer through our platform on web, mobile, and virtual reality interfaces (collectively, the Service) BY CLICKING THE “AGREE” BUTTON AND/OR BY USING THE SERVICE, YOU (A) ACKNOWLEDGE THAT YOU HAVE AND UNDERSTOOD THESE TERMS; (B) REPRESENT THAT YOU ARE 18 YEARS OF AGE OR OLDER/OF LEGAL AGE TO ENTER INTO A BINDING AGREEMENT; AND (C) ACCEPT THESE TERMS AND AGREE THAT YOU ARE LEGALLY BOUND BY ITS TERMS. IF YOU DO NOT AGREE TO THESE TERMS, DO NOT USE THE SERVICE AND, IF APPLICABLE, DELETE IT FROM YOUR WEB BROWSER OR MOBILE DEVICE.
By signing up and using the service, you, as the user, represent that if you are a representative of an organization (hereinafter referred to as “customer,” “user,” or “member”), you are duly authorized to enter into these terms on behalf of the customer. You and the customer hereby agree to these terms and the Privacy Policy, both of which are incorporated into and governed by these Terms. If any inconsistency arises between a provision in these Terms and a provision in any services agreement entered into between the Company and the customer (“services agreement”), the provision of the services agreement shall govern.
1. Changes to Terms
SwiftXR reserves the right, in its sole direction, to change, modify, replace, add to, supplement or delete any terms and conditions of these Terms (including the Privacy Policy, which is incorporated into and governed by these Terms) or to impose new conditions on the use of the Site, from time to time; provided, however, that SwiftXR will use reasonable efforts to provide you with notification of any material changes (as determined in our sole discretion) by email, postal mail, website posting, pop-up screen, or in-service notice. You should visit this page whenever you use the Service to review these Terms and learn if any terms have changed. If any future changes to these Terms are unacceptable to you or cause you to no longer be in compliance with these Terms, you must immediately stop using the Service. Your continued use of the Service following any revision to these Terms constitutes your complete acceptance of any such changes.
2. Access to the Service
Subject to these Terms, SwiftXR grants you a limited, revocable, non-exclusive, and non-transferable license to use the Service to which you have subscribed for your personal and non-commercial use, strictly in accordance with these Terms and any other instructions you may receive from SwiftXR regarding the Service. Depending on your subscription, the Service may provide you with access to a specific application located at the Site or its subdomains, as well as to products and services accessible there. Certain features, functionalities, and content available may be hosted on the Site. Accessing and using such Service or Application may require you to acknowledge your acceptance of these Terms of Use and Privacy Policy at the time of your subscription and/or to register on the Website; failure to do so may limit your access to or use of certain features and functionalities of the Site.
3. Use of Service
3.1 User Accounts; Registration.
All individuals who use the Service, whether or not they hold a registered account, are considered “users” under this Terms of Service (TOS). Upon registering for the Service and creating an account (“Account”), a user is designated as a “member.” To create an Account and become a member, you must be at least 13 years old. Individuals under 13 are not permitted to register or otherwise become members of the Service. Additionally, you must be in good standing and must not have been previously barred from accessing SWIFTXR services under the laws of the United States or any other applicable jurisdiction. Users who are under the legal age of majority may access the Service only under the conditions outlined in these Terms of Service and the incorporated Privacy Policy.
3.2 Affirmative Representations Regarding Your Use of the Service.
By using the Service, you confirm that:
Providing false, inaccurate, or incomplete information knowingly may result in the suspension or termination of your Account and access to the Service. SwiftXR reserves the right to prohibit or reject any further use of the Service, in whole or in part.
3.3 User Name, Password and Security.
After providing the requested registration data and creating your username, you will receive a random password, which you can later change alongside your Account designation. You are responsible for maintaining the secrecy and confidentiality of your password and for all activities that occur on or within your Account. You are responsible for notifying SwiftXR immediately if you notice any unauthorized access or use of your Account or password or any other breach of security. SwiftXR shall not be held liable for any loss and/or damage arising from any unauthorized access or use of your Account due to your failure to comply with the terms of this TOS.
3.4 Use of the Service by Minors.
